The Property Manager means the user who has listed properties for rental in the Rentalsystems database. This is typically the owner but could also be an authorised agent.
We, Us or The Website, Villarenters means Clickstay Ltd. (details of which appear below) which has published the properties from the Rentalsystems database
Clickstay Ltd. is a provider of software to facilitate the online display, booking of and payment of holiday home rentals to the consumer and holiday home manager
By clicking the checkbox you agree to the following
1.0 You are not entering into a contract with The Website or Clickstay Ltd. when you make a booking using the software that we provide. Instead you are booking directly with The Property Manager. The details of the above said contract are detailed in your booking contract that you agree to when you make an online payment for your booking.
1.1 You understand that We do not upload or maintain the information on the site and cannot guarantee its accuracy.
1.2 We provide you with information and analysis regarding previous bookings (the Rentalsystems Index) and their feedback (including star ratings). This is to assist you making a choice and a decision on the whether to book a property or not. You should therefore be aware that you are taking a greater risk by booking a property which has had no bookings or feedback reviews than you would be by choosing a higher Index property and one with a greater number of reviews and stars. That said we are not able to guarantee the quality of accommodation or service and any complaint can only be dealt with by the property owner or authorised agent.
1.3 You may of course voice any disappointment or delight in your accommodation by using the feedback review system. Every booking processed by us is invited and encouraged to leave a review after their stay. You will receive an email after your stay for this purpose
1.4 Providing you follow the payment instructions that we provide to you as part of our service in facilitating your booking you will be able to pay for your booking by credit card (or debit card GBP payments only). By doing so any refunds due to cancellations or any other reason with agreement of The Property Manager. If you make any payments to The Property Manager by any means other than what We provide as part of our service we will not be able to assist you if you need to recover any losses that may be incurred
1.5 In order to facilitate your booking we charge a 4.5% processing fee, which includes all booking fees and card charges, which is deducted from sums paid by you to The Property Manager. This is non-returnable in the case of cancellation by you.
1.6 If the Security Deposit Damage Waiver is offered to you by Us and you pay the breakage waiver fee requested, We agree to arrange for you an insurance policy in accordance with the terms summarised in the section below headed “Security Deposit Damage Waiver”.
Money back guarantee
In the unlikely event that on arrival your accommodation is not available or materially different from that displayed on the website, we will re-imburse you in full on behalf of The Property Manager providing the following conditions are met
a) You do not stay at the accommodation or any alternative accommodation offered by The Property Manager.
b) You contact us within 48 hours.
c) You provide us with invoices for alternative accommodation within 7 days of the end of the booking period.
d) You have not already been refunded by The Property Manager or reached agreement on a refund.
In order to process your booking we need to collect certain personal details from you. These details will include, where applicable, the names of party members, at least the party leader’s contact details (including email address), at least the party leader’s credit/debit card details, etc which we do not store. If we need further details we will ask you for these. We will use the contact details you have given us to correspond with you in relation to your booking or enquiry. We will also need to pass your details to the third parties who need to know them so that your chosen accommodation can be provided or your enquiry can be dealt with. The owner of the accommodation you have booked or enquired about may contact you direct using the details you have given us. Your details may be passed to third parties in countries outside of the European Economic Area if necessary in order to arrange for your booking to be provided or enquiry answered. These countries may not provide the same level of protection for your personal data as the UK. By submitting your booking or your enquiry to us, you agree to your personal details being processed in this way.
If you have subscribed to our e-mail service or have made a booking for, or an enquiry about, the services we offer, we may send you very occasional and targeted promotional e-mails about the services and special deals we offer unless you have opted out of receiving these.
We may need to disclose our customer database, including any personal data relating to you contained therein, to a third party who acquires or attempts to acquire all or substantially all of the assets or stocks in our company or our website whether by merger, acquisition, reorganisation or otherwise.
Except where expressly permitted by the Data Protection Act, we will only deal with the personal details you give us as set out above unless you agree or tell us otherwise. We have appropriate security measures in place to protect this information.
You are generally entitled to ask us (by letter or e-mail) what details of yours are being held or processed, for what purpose and to whom they may be or have been disclosed. We will charge a fee to respond to such a request. We promise to respond to your request within 40 days of receiving your written request and fee. In certain limited circumstances we are entitled to refuse your request.
If you believe that any of your personal details which we are processing are inaccurate or incorrect please contact us immediately.
This privacy statement covers websites owned and controlled by us only. Links to other websites and any information collected by these sites are not covered by this privacy statement. As our privacy statement may change due to developments in the law, we would encourage you to reread our privacy statement from time to time so that you are aware of any changes in how we gather and use personal information.
Security Deposit Damage Waiver
The following statements apply to the security deposit damage waiver, if available, when the breakage waiver fee has been paid.
Villarenters have arranged for your security deposit damage waiver to be insured with Focus Insurance Company Limited. Subject to payment of the premium this policy covers you for any accidental breakage claims, up to the Security Deposit amount of £300 (or €340 or $450 as applicable), and covers the cost of any damage or loss to the accommodation or to any fixtures, fittings, contents, furniture, furnishings, appliances and the like at or in the accommodation accidently caused by you or any member of your party. The maximum sum insured by this policy is £300 (or €340 or $450 as applicable). A full copy of the insurance policy is available to you on request.
You must take all reasonable precautions to avoid loss, theft or damage and take all reasonable steps to safeguard the property from loss or damage and to recover any of the property that is lost or stolen.
Reporting and acceptance of a claim: Any event giving rise to a claim under this policy must be reported within 14 days to Villarenters. You must also tell us if you are aware of any writ, summons or impending prosecution relating to damages at the rented property. We will handle the damage claims directly with the Villa owner.
All communication relating to your claim must be sent to Villarenters as soon as possible. You or anyone acting on your behalf must not negotiate, admit or repudiate (refuse) any claim without our permission in writing. You must not admit any liability or pay, offer to pay, promise to pay or negotiate any claim without our permission in writing. You or your legal representatives must supply at your own expense, all relevant information requested by us.
Acceptance of a claim and right to refuse indemnity: We are entitled to refuse to accept a claim or to continue to indemnify you where in our opinion:
a) You have not disclosed any material information to the Insurers;
b) You have failed to provide us with any relevant information and or supporting evidence following the incident giving rise to the claim.
If we refuse to accept a claim or to continue to indemnify you, we will give the reason(s) in writing to you. The insurance policy has a full complaints procedure and will be supplied to you in full if for any reason we do not pay your claim.
EXCLUSIONS: This policy does not cover any claims arising from sections 1 to 3 below:
1. Unlawful action or deliberate acts: Your own unlawful action or any criminal proceedings against you or any deliberate and wilful acts on your part or any fraud committed by you.
2. Additional loss or expense: Any other loss, damage or additional expense following on from the event for which You are claiming, unless We provide cover under this insurance. Examples of such loss, damage or additional expense would be the cost of replacing locks after losing keys, costs incurred in preparing a claim or loss of earnings following bodily injury, illness or disease.
3. Ownership, possession and use of mechanically propelled vehicles, aircraft or watercraft (other than surfboards or manually propelled rowing boats, punts or canoes).
